डाक टाइम्स कुशीनगर। प्रभारी अधिकारी निर्वाचन(पंचायत एवं नगरीय निकाय) / मुख्य विकास अधिकारी श्रीमती अनुज मलिक ने बताया कि राज्य निर्वाचन आयोग के निर्देशानुसार त्रिस्तरीय पंचायत सामान्य निर्वाचन 2021 के संदर्भ में निर्वाचन लड़ने वाले किसी भी प्रत्याशी की जमानत की धनराशि तब तक वापसी नहीं की जाएगी जब तक उसने आयोग द्वारा जारी किए गए आदेशों के अनुसार संबंधित निर्वाचन में अपने द्वारा किए गए व्यय का विवरण पत्र निर्वाचन घोषणा के 3 महीने के अंदर दाखिल न कर दिया हो एवं जमानत वापसी का प्रार्थना पत्र 3 महीने की अवधि में दे दिया हो।
श्रीमती मलिक ने बताया कि उस प्रत्याशी की जमानत की धनराशि वापस नहीं की जाएगी जिसमें मतदान में पड़े कुल वैध मतों के 1/5 अंश से कम मत प्राप्त किए हो , किंतु निर्वाचित घोषित प्रत्याशी पर कुल वैध मतों के 1/5 से कम मत प्राप्त करने का कोई प्रतिबंध नहीं होगा।
उन्होंने बताया कि यदि कोई प्रत्याशी नामांकन पत्र खरीदने और जमानत धनराशि जमा करने के पश्चात नामांकन पत्र दाखिल नहीं करता है या फिर अपना नाम वापस ले लेता है या उसका नामांकन पत्र निरस्त हो जाता है इन दशाओं में प्रत्याशी द्वारा जमा की गई जमानत धनराशि उसे वापस कर दी जाएगी।
इसी प्रकार यदि कोई प्रत्याशी सामान्य निर्वाचन में एक ही पद के लिए निर्धारित जमानत राशि एक से अधिक बार जमा कर देता है ,ऐसी स्थिति में उसके द्वारा जमा की गई सभी जमानत की धनराशि उसे वापस कर दी जाएगी किंतु चुनाव में पराजित होने और मतदान में पड़े कुल वैद्य मतों के 1/5 अंश से कम मत प्राप्त करने पर ऐसी समस्त धनराशियों में से केवल एक जमानत धनराशि जब्त हो जाएगी एवं अन्य जमानत धनराशि उसे वापस करा दी जाएंगी।
उन्होंने बताया कि यदि मतदान प्रारंभ होने के पहले किसी प्रत्याशी की मृत्यु हो जाती है तो उसके विधिक उत्तराधिकारी को जमानत धनराशि वापस कर दी जाएगी ।
*यदि आरक्षित वर्ग के किसी प्रत्याशी द्वारा अनारक्षित वर्ग के प्रत्याशी के लिए निर्धारित धनराशि के बराबर जमानत धनराशि जमा कर दी गई है तो जितनी अधिक धनराशि जमा की गई है उसे वापस कर दी जाएगी। उन्होंने बताया कि त्रिस्तरीय पंचायत सामान्य निर्वाचन 2021 में समस्त पदों पर चुनाव लड़ने वाले प्रत्याशियों को नाम निर्देशन पत्र क्रम करते समय निर्वाचन में व्यय विवरण का प्रारूप उपलब्ध कराया गया था परंतु अभी तक किसी प्रत्याशी द्वारा व्यय विवरण उपलब्ध नहीं कराया गया है।
मुख्य विकास अधिकारी ने समस्त खंड विकास अधिकारियों को निर्देशित किया है कि सदस्य ग्राम पंचायत, प्रधान तथा सदस्य क्षेत्र पंचायत के निर्वाचन लड़ने वाले प्रत्याशियों को सूचित कर निर्वाचन परिणाम घोषणा के 3 महीने के अंदर निर्वाचन व्यय का विवरण, जमानत वापसी करने का प्रार्थना पत्र नियत दिनांक के अंदर अपने विकास खंड कार्यालय पर जमा कराना सुनिश्चित करें तथा नियत समय समाप्ति के पश्चात् उनके विवरण सूचीबद्ध कर उपलब्ध कराएं।
